EULA - End User License Agreement

Please read carefully the terms and conditions of this document, before the use of our products or
services. The following license agreement represents the terms of the contract between the user and
RMG MusIC Software for the use of our products and services.
By purchasing, downloading or installing our software, the user declares to know and accept these
conditions. If you disagree with them, do not download, install, copy, use, or access to our software.
If you are an individual, you must be at least 18 years old, or have reached the legal age in the State,
province or country where you reside in order to celebrate this agreement. If you purchase the
Software on behalf of an entity, you must be duly authorized to represent that entity and accept this
agreement on their behalf. In accordance with the terms and conditions of this agreement, RMG
MusIC Software grants you the right of access to the download, installation and use of the software
in non-transferable, revocable and non-exclusive way only for personal use, and in the manner for
which it was designed. You agree that, both the software and the information related to it are
property of RMG MusIC Software.This license does not grant you any rights for updates, or other
RMG MusIC Software products.
This license allows the use of the software on a computer of your property, once the copy is
authorized through our website, for professional use on stage even though this presence on the
stage is lucrative for you as part of the performance of your job.
After you have registered on our website, and purchased any of our products, a box with the
products you have purchased, their respective installation codes and remaining validations appears
after Log-In on 'My account' page. These codes are personal and not transferable and you cannot
validate a copy of the software if not used in the installation.
Due to the diverse and unpredictable nature of devices and environments that this software may be
used, RMG MusIC Software declines any responsibility for the consequences that may have the use of
this software or our web site, and disclaims any warranty whether expressed or implied in the use of
the services and products that we sell and provide , or the services or products that third parties
could offer through links to other sites as well as of the consequences of the access to those pages
through those links. We take no responsibility for any damages that may arise from the use or
misuse, or inability to use our products in any situation or computer equipment, declaring that the
responsibility for the use of our services and products is exclusively of the user. We do not warrant
that the software or services are free from errors, interruptions or other failures or that the
software or services will meet your requirements in full.
RMG Music Software will not be in any case responsible for interruption of works, troubleshooting
or computer failure, loss of data, theft of personal identifying information, cost of procurement of
alternative software or replacement services, or any other type of loss or indirect damage. We do
not guarantee that any particular computer is compatible with our software and services. The user is
solely responsible for taking appropriate actions to keep the computer's security, as well as other
actions to avoid any loss of files or data.
Our total liability for direct damages shall not exceed in any case the price you paid for
our software or services.
The Software is protected by the Spanish copyright law, international treaties and any other
applicable laws in the country where it is used. We retain ownership of all rights, titles and interests
relating to the Software, including the rights of copyright, patents, trade secrets, trademarks and
other intellectual property rights. Unless otherwise specified in the legislation, anyone who
reproduces or distribute the Software without our permission may be subject to civil or criminal
sanctions. This provision does not apply to the module 'Midiio32.ocx' which is installed on your system
along with this software, and is licensed as GNU GPLv2. You can download it and use it without any
restrictions other than those imposed by the mentioned license, from our web site at
http://musicpot.es/Downloads.aspx and clicking on 'Mabrymidi' in the 'Other downloads' section.
Possession, installation or use of this Software doesn't grant you any right of ownership of its
intellectual property. The only rights acquired are listed in this license agreement. You cannot delete
distinguishing marks or notices of ownership of the Software or the documentation.
Any comments, opinion or suggestions you provide to us about this Software and services, will granted
us a perpetual, non-exclusive rights exempt from royalties, worldwide and irrevocable to use, copy,
distribute, make derivative works from, display, exhibit or incorporate your information into any
RMG Music Software product and exploit it in any manner at our discretion, without any
compensation to you, and without your explicit consent.
We may unilaterally terminate this license agreement, your account and access to the software and
services, if we determine only in our view, that it has made or attempted to make reverse
engineering, disassembled, decompiled, or try in any manner to extract the source code of the
Software, adapted or modified the software or created works derived or based on it, reproduced,
duplicated, copied, sold, resold or exploited the software or part of it, or used for any commercial
purpose other than the one that has been licensed for, with the only exception of the previously
mentioned 'Midiio32.ocx' module.
This license agreement supersedes any other communication, declaration, or advertising relating to
the Software and the documentation. If for any reason, any part of this license agreement is deemed
unenforceable, the rest of this will remain fully in force.
RMG Music Software can upgrade this license agreement when it deems appropriate or relevant by
changes in legislation or other reasons which justify it, so you should check it periodically on our
website 'http://musicpot.es'. Any changes made by RMG MusIC Software in this license
agreement will be posted on our website and/or communicated to all of our customers by email to
the registered accounts.
SOFTWARE ACTIVATION
Once installed, the first time the software runs will provide you with a 'Challenge' code that you
must paste into our website 'http//musicpot.es' in 'My account' page in the 'Challenge' box, after
Log-In with your credentials. After pressing 'Validate License' the system will provide you a code in
the 'Response' field, which the software is waiting for, in order to run. If the 'Response' is positive
the software will run. If you make significant changes to your hardware or reinstall your operating
system, you may need to re-validate your copy. A major change in the hardware can be indistinguishable
from a full computer change. In such case, you must use a new validation of the three available by
license to continue using the product.
Each copy will receive the validation of the web site, up to three different machines. Machine
identification will be made through the MAC network identification number and/or the motherboard serial
number, and/or a code generated by the software to identify the machine, and will be collected from
your computer during the installation and/or copy validation. When a license appears on our database
validated on three different machines, that license will not validate on a machine other than those
three. For that you need to purchase a new license. On a machine that has already been activated before,
the number of activations of that copy is unlimited, depending only on the commercial life of the
product and our company, and the operation availability of our web site.

Lea cuidadosamente los términos y condiciones del presente documento, antes de la utilización de nuestros
productos o servicios. El siguiente Acuerdo de Licencia representa las condiciones del contrato entre el
usuario y RMG Music Software para el uso de nuestros productos y servicios.
Comprando y descargando el software desde nuestro sitio web, el usuario declara conocer y aceptar estas
condiciones. Si no está de acuerdo con ellas no descargue, instale, copie, use, o tenga acceso a nuestro
software.
Si es usted una persona física, deberá tener al menos 18 años o haber alcanzado la mayoría de edad en el
estado, la provincia o el país que resida para poder celebrar este acuerdo. Si adquiere el Software en nombre
de una entidad, habrá de estar debidamente autorizado para representar a dicha entidad y aceptar este
acuerdo en su nombre. De conformidad con los términos y condiciones de este acuerdo, RMG Music
Software le otorga el derecho de acceso a la descarga, instalación y uso del software de forma intransferible,
revocable y no exclusiva, únicamente para uso personal y no comercial. Usted acepta que tanto el software
como toda la información relacionada con él son propiedad de RMG Music Software. Esta licencia no le
otorga ningún derecho con respecto a actualizaciones, ni otros productos de RMG Music Software.
Esta Licencia le autoriza a usar este software en un ordenador de su propiedad una vez que su copia haya
sido validada por nuestra página web, para uso profesional en el escenario incluso cuando ésa actividad
en el escenario sea lucrativa para usted como parte de su trabajo.
Una vez que usted se registre en nuestra página web y adquiera uno de nuestros productos, cuando se
identifique aparecerá al final de la página ‘Mi Cuenta’ un cuadro con los productos que haya adquirido, sus
códigos de instalación y el número de validaciones restantes de cada uno de ellos. Estos códigos son
personales e intransferibles y el programa no funcionará si no los utiliza al instalarlo.
Debido a la naturaleza diversa e imprevisible de los dispositivos y entornos en los que puede ser usado,
RMG Music Software declina toda responsabilidad por las consecuencias que pueda tener el uso de su
software o de su página web, y rechaza cualquier garantía ya sea expresa o implícita en el uso de los
servicios y productos que vende y presta, o de los servicios o productos que ofrezca de terceros a través de
links a otras paginas así como de las consecuencias que pudiera tener el acceso a ésas otras páginas a
través de ésos links. Tampoco se responsabiliza de los daños que puedan derivarse del buen o mal uso, o
la imposibilidad del uso de nuestros productos en ninguna situación o equipo informático, declarando que
la responsabilidad del uso de nuestros servicios y productos es exclusivamente del usuario. No garantizamos
que el software ni los servicios estén libres de errores, interrupciones u otros fallos, ni que el software o los
servicios satisfagan al completo sus necesidades.
RMG Music Software no será en ningún caso responsable ante usted por interrupción de trabajos, averías o
fallos informáticos, pérdidas de datos, robo de información de identificación personal, coste de obtención de
software alternativo, o de servicios de sustitución, ni ningún otro tipo de pérdida o daño indirecto. No
garantizamos que ningún equipo concreto sea compatible con nuestro software y servicios. El usuario es
el único responsable de tomar las medidas pertinentes para realizar una copia de seguridad de su Equipo, así
como otras medidas para evitar cualquier pérdida de archivos o datos.
Nuestra responsabilidad total por daños directos no superará en ningún caso el precio que usted haya abonado
por nuestro software o servicios.
El Software se encuentra protegido por las leyes españolas de copyright, tratados internacionales y cualquier
otra ley aplicable en el país donde se utilice. Nosotros conservamos la propiedad de todos los derechos,
títulos e intereses relativos al Software, incluidos los derechos de copyright, patentes, secretos comerciales,
marcas comerciales y otros derechos de propiedad intelectual. Salvo disposición en contrario en la legislación,
cualquiera que reproduzca o distribuya el Software sin nuestro permiso podrá ser objeto de sanciones civiles o
penales. Esta disposición no es aplicable al módulo Midiio32.ocx’ que se instala en su sistema junto con el
software y que está licenciado como GNU GPLv2. Puede usted descargar y usar libremente dicho módulo con
las únicas limitaciones que impone la citada licencia, desde nuestro sitio web
http://musicpot.es/Downloads.aspx pulsando sobre el botón ‘Mabrymidi’ en ‘Otras Descargas’.
La posesión, instalación o utilización del Software por su parte no le transfiere ningún derecho de titularidad
sobre la propiedad intelectual de este. Los únicos derechos que adquiere son los expuestos en el presente
Acuerdo de licencia. No podrá eliminar las marcas distintivas ni los avisos de propiedad del Software ni de la
Documentación.
Cualquier comentario, opinión o sugerencia que nos facilite sobre el Software y los servicios nos concede una
licencia perpetua, no exclusiva, exenta de cánones, mundial e irrevocable para utilizar, copiar, distribuir, realizar
trabajos derivados de, mostrar, exhibir o incorporar su información en cualquier producto de RMG Music Software
y comercializar de otro modo la Información a nuestra única discreción, sin compensación alguna para usted y
sin su aprobación explícita.
Podremos rescindir este Acuerdo de Licencia, su cuenta y acceso al software y servicios si determinamos
únicamente a nuestro juicio, que ha realizado o intentado realizar ingeniería inversa, desensamblado,
descompilado o tratado de extraer de otro modo el código fuente del Software, adaptado o modificado el
software o creado trabajos derivados basados en él, reproducido, duplicado, copiado, vendido, revendido o
explotado el software o parte de él, para cualquier fin comercial distinto a aquél para el que ha sido licenciado
con la única excepción del citado módulo ‘Midiio32.ocx’.
El presente Acuerdo de Licencia sustituye a cualquier otra comunicación, declaración o publicidad referentes al
Software y a la Documentación. Si por algún motivo, alguna parte de este Acuerdo de Licencia se considerase
inaplicable, el resto de éste seguirá totalmente en vigor.
RMG MusIC Software puede actualizar este acuerdo cuando lo considere necesario o relevante, por cambios
en la legislación u otras razones que lo justifiquen. Por ello debería revisarlo periódicamente en nuestro sitio
web 'http://musicpot.es'. Cualquier cambio en este acuerdo de licencia será publicado en nuestro
sitio web y/o comunicado a todos nuestros clientes al correo con el que se hayan registrado en nuestra base
de datos.
ACTIVACIÓN DEL SOFTWARE
Para poder usarlo, debe solicitar en nuestra página web el código de activación que le pedirá el software en
el primer arranque. Para solicitarlo deberá identificarse y entrar en su cuenta. Luego en la casilla
'Challenge' deberá escribir o pegar el código 'Challenge ' que el programa le muestra y pulsar sobre el botón
'Validar software'. El sistema le entregará un código de 'Respuesta' que desbloqueará el programa si es de
validación. Si realiza cambios importantes en su hardware o reinstala el sistema operativo, puede necesitar
volver a activar su copia. Un cambio importante en el hardware, puede ser indistinguible de un cambio
completo de ordenador. En ése caso deberá utilizar otra de las tres activaciones disponibles por licencia para
continuar usándolo. Cada licencia se podrá validar hasta en tres máquinas diferentes. La identificación de la
máquina se hará a través del numero MAC de la placa de red y/o del serial de la placa base y/o un código
generado por el propio software, informaciones que se recogerán de su equipo durante la instalación/activación.
Cuando en nuestra base de datos figure la activación de una copia en tres máquinas diferentes la copia no se
volverá a activar en una maquina distinta a esas tres. Para eso deberá adquirir una copia nueva. En una
máquina en la que ya se ha activado antes, el número de activaciones de esa copia es ilimitado, condicionado
únicamente a la vida comercial del producto de que se trate, de nuestra empresa y del estado de operatividad
de nuestra página web.
